Purchasing real estate in Guyana involves specific legal steps. Here's what to expect from search through to title transfer.
Engage a lawyer early
Property transactions in Guyana require a licensed attorney. Engage one before you make an offer — they handle title searches, draft the sale agreement, and oversee the transfer. Expect legal fees of 1–2% of purchase price.
Check the title (Transport)
In Guyana, freehold land ownership is evidenced by a "Transport" (not a title deed as in other countries). Your lawyer will search the Deeds Registry to confirm the seller holds a clean Transport with no encumbrances or disputes. This step is non-negotiable.
Make an offer & sign a sale agreement
Once satisfied, make a written offer. On acceptance, a Sale & Purchase Agreement is signed and a deposit paid (typically 10%). The agreement specifies: price, deposit, completion date, and what's included (fixtures, fittings).
Arrange financing
Most buyers pay cash or use a local bank mortgage. Republic Bank, Demerara Bank, and Citizens Bank offer mortgages — expect 5–9% interest rates and up to 70% LTV. The bank will require a valuation report from an approved valuer.
Pay stamp duty and fees
Transfer of Transport attracts stamp duty (currently 2.5% of assessed value for residential). Additional costs: Deeds Registry fees, lawyer fees, surveyor/valuation fees. Budget an additional 5–8% on top of purchase price for all costs.
Transfer of Transport
Your lawyer prepares the Transfer of Transport document, which both parties execute before a Notary/Commissioner of Oaths. This is lodged at the Deeds Registry. Processing time is typically 4–12 weeks. Upon completion, you receive your Transport — you own the property.
